These terms govern access to our B2B catalog, member accounts, and enquiry services. By using the site you agree to them.
These Terms & Conditions (“Terms”) govern your access to and use of elitegifting.com, our online B2B catalog, member accounts, downloadable materials, and enquiry channels (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you are using the Services on behalf of a company, you represent that you have authority to bind that company. If you do not agree, do not use the Services.
The catalog is designed for business buyers, including corporate HR, marketing, procurement, agencies, and resellers acting in a commercial capacity. You must be at least 18 years old and capable of forming a binding contract. You agree not to use the Services for unlawful purposes, to misrepresent your business identity, or to scrape, reverse engineer, or overload our systems without written permission.
Some features require registration. You agree to provide accurate company and contact information and to keep credentials secure. Accounts may be subject to admin approval. We may approve, suspend, or decline registrations at our discretion (for example, incomplete business details or suspected misuse). You are responsible for all activity under your account. Notify us immediately of unauthorized use.
Product descriptions, images, specifications, and prices are provided for business reference. We strive for accuracy but do not warrant that all content is error-free or current. Pricing visibility may depend on login status, account approval, and per-product settings (“show price when logged in” or enquiry-only items). Listed prices, where shown, are indicative unless confirmed in a written quotation or order acknowledgment. Stock, MOQ, and lead times change frequently. Availability is confirmed only when we accept your order or issue a formal quote.
Submitting an enquiry, WhatsApp message, or contact form does not create a binding order. A contract is formed only when both parties agree to written terms (email confirmation, purchase order acceptance, or proforma invoice). Quotes may expire after a stated validity period. Customization, branding, packaging, and multi-location shipping may affect final pricing and timelines. You are responsible for reviewing proofs, artwork approvals, and shipping details before production begins.
When you request logo printing, engraving, embossing, UV, silk screen, or bespoke packaging, you represent that you have rights to supply artwork and brand assets. You grant us a limited license to use supplied files solely to fulfill your order. You are responsible for color variance between digital proofs and finished goods within normal manufacturing tolerances. We may refuse jobs that infringe third-party rights or violate applicable laws.
Payment terms (advance, partial, or credit) are agreed per order. Unless stated otherwise, prices are exclusive of applicable GST and shipping. Invoices will be issued in accordance with Indian tax regulations. You agree to provide valid GSTIN and billing details where required. Late payments may delay dispatch or future credit terms.
We coordinate dispatch across India to single or multiple locations. Estimated delivery windows depend on product type, customization, carrier performance, and peak seasons (festive periods, year-end). Risk of loss passes according to agreed commercial terms (often upon delivery to your nominated address or handover to carrier, as stated on the order). You are responsible for providing accurate addresses, contact persons, and receiving hours.
Custom-branded goods are generally non-returnable except for manufacturing defects or material deviation from approved specifications. Report visible transit damage or quantity discrepancies within the timeframe stated on your delivery documentation, with photos where possible. We will work in good faith to replace or remedy qualifying defects; remedies may exclude consequential business losses unless expressly agreed in writing.
All website content—including layout, text, photography, logos, and catalog PDFs—is owned by Elite Gifting or licensors and protected by copyright and trademark laws. You may not copy, redistribute, or commercially exploit catalog assets without written permission. Limited use for internal procurement evaluation is permitted. “Elite Gifting” and related marks may not be used in a way that suggests partnership or endorsement without consent.
You agree not to: • Upload malware or attempt unauthorized access to systems or accounts • Harvest other users’ data or spam our channels • Use automated bots to download entire catalogs in a way that impairs service • Post unlawful, defamatory, or infringing content in any user-submitted field We may suspend access for violations and cooperate with law enforcement where required.
The Services are provided on an “as is” and “as available” basis to the fullest extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement except where such disclaimers are not allowed. Product images are representative; minor color, finish, or packaging variations may occur. Third-party brand names on products are property of their respective owners.
To the maximum extent permitted by applicable law, Elite Gifting and its directors, employees, and suppliers shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data arising from use of the Services. Our aggregate liability for any claim relating to the Services shall not exceed the amount you paid to us for the specific order giving rise to the claim in the twelve (12) months preceding the event, or INR 10,000 if no such payments apply—whichever is greater, unless mandatory law requires otherwise.
You agree to indemnify and hold harmless Elite Gifting from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Services, or infringement arising from artwork or instructions you provide.
These Terms are governed by the laws of India. Courts in Mumbai, Maharashtra shall have exclusive jurisdiction, subject to any mandatory consumer protection rules that cannot be contracted away (typically not applicable to pure B2B transactions). We encourage good-faith resolution of disputes through direct communication before formal proceedings.
We may modify these Terms at any time. Updated Terms will be posted on this page with a revised “Last updated” date. Material changes may be highlighted on the site or notified to registered users. Continued use after changes constitutes acceptance unless applicable law requires explicit consent.
